Do you need a lawyer for a car accident claim?

After you have been in a car accident, you will likely have to make some difficult decisions. If you have been injured or suffered vehicle damage, you will want to file a claim with the insurance company. If you do so, you might also need to determine if hiring legal representation is worthwhile and if it will be beneficial to your case.

As with other legal issues, there are circumstances that may require advice and guidance from an attorney and those that may not.

The following is a list of considerations to help you determine if you need help with your car accident case.

  • Is it clear who is at fault or will that be contested? If the other driver admits that they caused the accident, and their insurance company agrees, then you may not need help with your claim. If the burden falls on you to prove fault, however, it may be wise to not proceed with the case without an attorney's help.
  • How much will you end up needing to recover for damages? Are you paying thousands of dollars out-of-pocket for medical bills? Are you missing work because of your injuries? If so, you may want to consider hiring a car accident lawyer to help you obtain the maximum amount of financial compensation.
  • Did you sustain serious injuries with a substantial recovery time? If your injuries affected your life for a long period of time, or if you have sustained permanent, life-altering injuries, you have the potential to file a much larger claim. Consider hiring professional legal representation to build a strong claim on your behalf.
  • Will your case be going to court? If your case cannot be settled or resolved in small claims court, it might be in your best interests to hire a lawyer. With someone experienced on your side, you can feel more confident that your legal rights will be protected and best interests are represented.
  • Do you want to invest the time to learn how to settle and present your claim? Although it can vary from case to case the amount of time it takes to effectively handle a car accident claim can range from about five to 10 hours. This doesn't include the time you will most likely need to spend learning about how to settle claims. If this is time you do not or cannot spend on your case, consider hiring a car accident attorney.
